At the end of August, an announcement was made that from 29 August 2020 the Coronavirus Act 2020 would be extended through to 31 March 2021. This Act was put into place to protect tenants from being evicted at short notice when the lockdown was in force.
From 29 August 2020, any landlord that wants to serve notice to tenants must give six months’ notice. This is part of the Government’s commitment to making £0sure that tenants are protected over the winter months.
Shorter notice periods for tenants
There are some situations when landlords have the right to issue shorter notice periods, such as:
New court rules when seeking possession
New court rules in be in place on 20 September 2020 that landlords need to be aware of as well. If you need to start court proceedings, then it is essential that you set out in your claim all the information explaining the circumstances that have led to you seeking possession. You must also state the impact of COVID-19 and how this has affected you and your tenant.
If all the information is not provided, then the judges can adjourn the proceedings which can cause a delay in getting the case resolved.
The Secretary of State for Housing, Rt Hon Robert Jenrick MP explained that ‘These changes will support landlords to progress the priority cases while?keeping the public safe over winter.? We will keep these measures under review?and decisions?will continue?to be guided by the latest public health advice.’
